METODOLOGÍA PARA LA PRONTA CONCLUSIÓN DE LAS NEGOCIACIONES PARA LA BÚSQUEDA DE CONSENSOS DEL GRUPO DE TRABAJO ENCARGADO DE ELABORAR EL PROYECTO DE DECLARACIÓN AMERICANA SOBRE LOS DERECHOS DE LOS PUEBLOS INDÍGENAS

Por medio de la presente, el Grupo de Trabajo encargado de elaborar el Proyecto de Declaración Americana sobre los Derechos de los Pueblos Indígenas, establece la metodología para la pronta conclusión de las negociaciones para la búsqueda de consensos, siguiendo los mandatos emanados de la Asamblea General en sus diversas resoluciones sobre el tema y específicamente, en sus resoluciones AG/RES.2073 (XXXV-O/05) y AG/RES.2234 (XXXVI-O/06).

Esta metodología tiene en cuenta aquella utilizada en las Siete Reuniones de Negociaciones que se iniciaron en el año 2003.

Durante la Séptima Reunión de Negociaciones realizada en Brasilia, Brasil, en marzo de 2006, el Grupo de Trabajo culminó con la primera ronda de negociaciones sobre las seis secciones del texto consolidado de la Presidencia (GT/DADIN/doc.139/03). El Grupo de Trabajo no ha negociado la parte preambular.

Para continuar con la transparencia y la buena fe que impera en las negociaciones, además de la certeza para las delegaciones de los Estados miembros y de pueblos indígenas (representadas a través de su Cónclave), el Grupo de Trabajo tendrá presente los principios de que "nada estará acordado hasta que todo esté acordado" y de que "nada será acordado sin la participación plena y efectiva de los representantes de los Pueblos Indígenas", así como de que deberá lograrse un consenso entre los Estados Miembros de acuerdo con la práctica común en la OEA.

Metodología

* Las sesiones serán públicas y abiertas; y a las mismas podrán asistir todas aquellas organizaciones indígenas interesadas en la negociación de la Declaración.

* La base de las negociaciones es el documento "Registro del Estado Actual del Proyecto de Declaración Americana sobre los Derechos de los Pueblos Indígenas" (GT/DADIN/doc.260/06 rev.1), enfatizando la consideración de las propuestas formuladas por las delegaciones de los Estados Miembros y de los representantes de los pueblos indígenas, registradas en los documentos

GT/DADIN/doc.255/06 rev. 1 y GT/DADIN/doc.259/06" /, así como, si fuera pertinente, los documentos donde aparecen los "resultados" de las anteriores reuniones de negociación.

* Al momento de la discusión, el artículo pertinente del documento base para las negociaciones figurará en pantallas en español e inglés, para facilitar la negociación y a fin de obtener el consenso.

* Luego de dar lectura al artículo en consideración, el Presidente del Grupo de Trabajo invitará a las delegaciones de los pueblos indígenas y de los Estados Miembros, a referirse al mencionado artículo para el logro de un consenso, subrayando la necesidad de encontrar soluciones de compromiso que aborden las preocupaciones más urgentes de los pueblos indígenas, así como las necesidades de todos los Estados Miembros en la elaboración del Proyecto de Declaración.

* En caso que surjan propuestas alternativas al texto en consideración, que sean presentadas por los Estados o por el Cónclave de los Pueblos Indígenas, estas serán sometidas a la consideración del Grupo de Trabajo. Dichas propuestas deberán ser confirmadas por escrito. De no contarse con el consenso necesario, las propuestas que se reciban por escrito quedarán registradas en los documentos oficiales en los que se registren las propuestas que se presenten durante la respectiva Reunión de Negociaciones.

* Una vez que se haya alcanzado el consenso, el artículo se reflejará en pantallas, en español e inglés, la Presidencia anunciará que ha sido aprobado por consenso y la Secretaría General lo incluirá en el documento oficial de la respectiva Reunión de Negociaciones, es decir, en el "Registro del Estado Actual del Proyecto de Declaración Americana sobre los Derechos de los Pueblos Indígenas".

* En caso de no alcanzarse el consenso, la Presidencia del Grupo de Trabajo invitará a las delegaciones a realizar consultas informales a fin de lograr un texto satisfactorio para las partes.

* En caso de persistir el disenso, la Presidencia presentará una propuesta alternativa para la consideración del Grupo de Trabajo.

* Si luego de estos esfuerzos no se logra el consenso, la palabra, frase o párrafo pendientes, quedarán entre corchetes.

PROCEDURE FOR PROMPTLY CONCLUDING THE NEGOTIATIONS IN THE QUEST FOR POINTS OF CONSENSUS OF THE WORKING GROUP TO PREPARE THE DRAFT AMERICAN DECLARATION ON THE RIGHTS OF INDIGENOUS PEOPLES

The Working Group to Prepare the Draft American Declaration on the Rights of Indigenous Peoples hereby establishes the following procedure for the prompt conclusion of negotiations in the quest for points of consensus, pursuant to the General Assembly mandates contained in various resolutions on the subject, specifically AG/RES. 2073 (XXXV-O/05) and AG/RES. 2234 (XXXVI-O/06).

This procedure takes into account the one followed in the seven meetings of negotiation, the first of which was held in 2003.

During the Seventh Meeting of Negotiations in the Quest for Points of Consensus, held in Brasilia, Brazil, in March 2006, the Working Group concluded the first round of negotiations on the six sections of the Chair's consolidated text (GT/DADIN/doc.139/03). The Working Group has not negotiated the preamble.

In the interest of preserving the transparency and good faith that have characterized the negotiations, and so that the delegations of member states and indigenous peoples (represented by their Caucus) will be certain as to where things stand, the Working Group will observe the principles that "nothing is agreed upon until everything is agreed upon"; that "nothing will be agreed upon without the full and effective participation of the representatives of the indigenous peoples"; and that, according to the usual practice at the OAS, a consensus should be reached among member states.

Procedure

* Meetings will be public and open; they may be attended by all indigenous organizations interested in the negotiation of the Declaration.

* The working document for negotiations will be GT/DADIN/doc.260/06 rev. 1, entitled "Record of the Current Status of the Draft American Declaration on the Rights of Indigenous Peoples," emphasizing consideration of the proposals of member state delegations and indigenous peoples'

representatives set forth in documents GT/DADIN/doc.255/06 rev. 1 and GT/DADIN/doc.259/062/ as well as the "outcomes" and "results" documents of prior negotiating meetings, if raised.

* As each article from the working document is discussed, it will appear on the screens, in Spanish and English, to facilitate negotiations and consensus.

* After reading out the article concerned, the Chair of the Working Group will invite the delegations of the indigenous peoples and the member states to refer to it in such a way as to facilitate a consensus, underscoring the need to find compromise solutions that address the most pressing concerns of the indigenous peoples as well as the needs of all member states in preparing the Draft Declaration.

* Should alternative proposals for texts under consideration be presented by the states or the Indigenous Peoples' Caucus, these will be submitted to the Working Group for consideration. Such proposals should be confirmed in writing. If the necessary consensus is not reached, proposals received in writing will be recorded in the official documents listing proposals submitted during the respective negotiation meeting.

* Once consensus has been reached, the article will be shown, in Spanish and English, on the screens. The Chair will announce that it has been approved by consensus and the General Secretariat will include it in the official document of the respective meeting of negotiations, i.e., in the "Record of the Current Status of the Draft American Declaration on the Rights of Indigenous Peoples."

* If no consensus is reached, the Chair of the Working Group will invite the delegations to hold informal consultations to find a text acceptable to all parties.

* Should consensus still not be reached, the Chair will present an alternative proposal for consideration by the Working Group.

* If, after these efforts, no consensus has been reached, the word, phrase, or paragraph still pending will remain in square brackets.
